Version 1.0 · Effective 8 November 2026.
These terms apply to quotations, bookings, once-off work, repairs and recurring support services supplied by Techular Solutions ("we", "us" or "our"). The customer is referred to as "you" or "the customer".
A quotation, service-specific agreement or subscription schedule may contain additional terms. If there is a conflict, the signed or expressly accepted service-specific agreement applies to that service to the extent of the conflict. By accepting a quotation, confirming a booking or subscribing to a package, you confirm that you have had an opportunity to review these terms before proceeding.
These terms do not exclude or limit any right or protection that cannot lawfully be excluded or limited. Please also read our Privacy Policy.
We provide IT support, troubleshooting, repair, installation, maintenance, cybersecurity and related technology services. Services may be delivered remotely, by drop-off or collection where offered, or at an agreed on-site location.
The accepted quotation or service order describes the agreed work, deliverables, service method, estimated time, rates, callout fees and any known exclusions. Estimates are not guarantees unless expressly stated as fixed commitments. Work outside the agreed scope requires your approval of any revised quotation or additional charges before we proceed.
We may recommend third-party products or services, but third-party terms and availability may apply. We will explain material third-party costs that we know about before obtaining your approval.
Each quotation states its validity period. If no period is stated, the quotation is valid for 14 calendar days from issue. A quotation may need to be revised if information supplied was inaccurate, the requested work changes, or inspection reveals additional faults or requirements.
We will explain the reason and price impact of material changes and obtain your approval before undertaking additional chargeable work, except where you have expressly authorised a defined diagnostic limit or other specific action in writing. Parts, licences, travel, third-party fees and other expenses are charged only as disclosed in the quotation or separately approved.
Prices will identify whether VAT is included or excluded, as applicable. A callout or travel fee may apply to an on-site visit and will be shown separately or otherwise disclosed before you accept the quotation.
Where available, you may accept or reject a quotation through our website or by another recorded method we approve. We may retain the quotation, its version, acceptance status, date and time, and related communications as evidence of the transaction. You should keep a copy of the quotation and these terms for your records.
Before accepting, check the customer details, service description, quantities, rates, fees and total. If you notice an error, contact us promptly so it can be corrected. Electronic acceptance does not remove any rights you have under applicable law.
After a quotation is accepted, we will arrange a service date and time with you, subject to availability. You must provide accurate contact details and ensure that an authorised person and the relevant device, system, premises or account are available when required.
Please request changes or cancellations as early as reasonably possible. If an appointment is cancelled late, access is unavailable, or nobody attends, we may charge a reasonable, previously disclosed fee for costs actually incurred or time reserved where permitted by law. Any applicable fee will be explained in the quotation or booking confirmation; we will not impose an undisclosed penalty.
If we need to reschedule, we will notify you and make reasonable efforts to agree an alternative time. Service dates may be affected by circumstances outside our reasonable control.
Once-off work will be invoiced according to the quotation or invoice. Unless a different period is stated, invoices are payable within 7 calendar days of issue. Monthly packages are billed at the frequency and on the date stated in the subscription details. Recurring payments are processed by the payment provider identified at checkout; we do not store full payment-card details where these are handled by that provider.
If a payment fails or an account becomes overdue, we may contact you to arrange payment and, after reasonable notice where appropriate, suspend non-emergency services until the account is brought up to date. Suspension will not remove your obligation to pay amounts properly due for services already supplied. Any interest, collection costs or other charges will be applied only where lawful and properly disclosed.
Please raise invoice queries promptly and identify the amount and reason disputed. You remain responsible for undisputed amounts by their due dates.
The subscription details will state the package, price, billing frequency, included services, service limits and any minimum term, if applicable. Unused support time or allowances do not carry over unless the subscription details say otherwise.
You may request cancellation using the contact details below or any cancellation method made available in your account. The effective date, notice period and any permitted cancellation charge depend on the agreement and applicable law. Where the Consumer Protection Act applies, statutory cancellation and fixed-term agreement rules will be respected. We will confirm the effective date and any final amount due.
Unless required by law or agreed otherwise, fees for a period already supplied or commenced are not automatically refundable merely because the package was not fully used. This does not affect any statutory refund or cancellation right.
If you cancel once-off work before it starts, we will refund amounts paid for work not performed, subject to applicable law and any reasonable, disclosed costs already incurred that may lawfully be charged. If work has started, you may be liable for work properly performed, approved parts or licences ordered for you, and other approved non-recoverable costs.
Refunds, remedies and cancellation rights required by consumer-protection or electronic-commerce legislation remain available where applicable. Contact us with your quotation or invoice number and the reason for your request so we can assess it.
IT work can involve risks to files, settings, availability and data, particularly where storage devices are failing, malware is present or systems are unstable. We will take reasonable care and use appropriate measures when performing the agreed work, but no technical process can guarantee that data will never be lost or that every security threat will be detected.
Remote access will be used only where reasonably necessary for the agreed service and with appropriate authorisation. You should close confidential material not needed for the task and supervise remote sessions where appropriate. We will not intentionally access unrelated information except where reasonably necessary to diagnose or complete the authorised work.
We process personal information in accordance with applicable privacy law and our Privacy Policy. Where a service requires us to process personal information on your behalf, additional written data-processing terms may be required. We will take reasonable steps to protect information in our possession and handle suspected security compromises as required by law.
Unless the quotation states otherwise, we provide a 30-day workmanship guarantee from completion for a fault directly caused by the specific work we performed. Please notify us promptly and provide reasonable access to inspect the issue. Where the claim is covered, we will assess and, as appropriate, correct the workmanship issue.
This guarantee does not cover unrelated or pre-existing faults, new damage, misuse, accidental damage, normal wear, malware introduced later, or changes made by you or another provider after completion, unless applicable law provides otherwise. Parts and third-party products may carry separate manufacturer or supplier warranties.
This additional guarantee does not replace or reduce any statutory warranty, quality, repair, refund or other right that applies under South African law.
We will perform services with reasonable care and skill. To the extent permitted by law, we are not responsible for losses caused by inaccurate information supplied by you, unauthorised changes by third parties, pre-existing defects, unsupported systems, failures of third-party networks or providers, or events beyond our reasonable control, except to the extent our own conduct gives rise to liability.
Nothing in these terms excludes or limits liability where exclusion or limitation is prohibited by law, including applicable liability for fraud, wilful misconduct, or any consumer rights that may not lawfully be waived. Any other limitation of liability must be interpreted only to the extent it is lawful and fair in the circumstances.
Neither party should be treated as guaranteeing uninterrupted, error-free or completely secure operation of all hardware, software, networks or third-party services. If a service interruption occurs, we will make reasonable efforts to communicate and resume the agreed work.
Each party should take reasonable steps to protect confidential business, technical and account information received from the other party and use it only for the relevant service or another lawful purpose. This does not prevent disclosure required by law or information that is already public other than through a breach of confidence.
You remain responsible for collecting your device and property after we notify you that work is complete. Any storage, collection deadline or uncollected-property charge must be disclosed separately and handled in accordance with applicable law; we will not treat customer property as ours merely because it has not been collected.
If you are dissatisfied with a service or invoice, contact us using the details below and include your quotation, booking or invoice reference, the issue and the outcome you are seeking. We will review the matter and try to resolve it fairly.
Nothing in this clause prevents either party from exercising a right to approach a competent regulator, ombud, tribunal or court where permitted by law.
We may publish updated terms from time to time. The version applicable to a transaction will be identified by its version or effective date and retained with the relevant acceptance record where our system supports this. Changes will not retrospectively remove rights or materially change an already accepted service agreement unless agreed by the parties or permitted by law.
For a new quotation or subscription, you will be given access to the applicable terms before acceptance.
These terms are governed by the laws of the Republic of South Africa. Disputes are subject to the jurisdiction of a competent South African forum or court, without preventing a consumer from using any forum or remedy made available by applicable law.
